Substandard commercial properties may be neglected by absentee owners or landlords causing the property to fall into distress or disrepair. Maintenance needs of substandard income-producing commercial properties are often ignored by the owner to maximize profit by minimizing expenses on needed maintenance. A Court-Appointed Health and Safety Receiver can be the solution to protect communities and tenants from substandard commercial properties. Health and Safety Receivers are appointed by the court and authorized to take temporary custody and control over substandard properties and potentially the operations of the on-site business. The receiver will conduct an inspection of the commercial property to address potential health and safety hazards, construction deficiencies, permitting regulations, and code violations. The receiver will manage and maintain the property in the best interest of all parties involved. Once the receiver is appointed by the court, the receiver will secure the property by changing the locks if necessary, control operating and utility accounts, ensure that adequate insurance coverage is established and preserved, confirm that taxes and operating expenses are current, supervise the management company if there is one, and guarantee that all necessary actions to preserve the property’s value are upheld. The receiver will notify the tenants of the change in control and provide contact information should the tenants have any issues or concerns. The receiver will take possession of the commercial property by collecting rental income and honoring the rights of the tenants, manage standing leases and implement new leases, repair and maintain the property as needed, maintain or enter into new service contracts with service providers, and oversee any issues regarding the overall operation and security of the property. The receiver will deter burglary, vandalism, and criminal conduct on the property safeguarding the welfare of the tenants, visitors and surrounding community.
